The rules for using DineTracer.

This document is a good-faith summary of how the service works and is provided for transparency. It is not legal advice; please review it against your own needs.

1Agreement

These Terms of Service ("Terms") govern your use of DineTracer (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2The Service

DineTracer compiles public government records and business information into early-stage sales leads about U.S. restaurants and food businesses, and provides tools to search, filter, export, and receive alerts about them.

3Accounts & eligibility

You must be at least 18 and provide accurate information. You are responsible for activity under your account and for keeping your credentials secure. You may sign in with email/password or with Google.

4Credits, payments & billing

Certain features are paid for with credits purchased through Stripe. Prices and credit costs are shown in the app and may change. Purchased credits are consumed when you take a billable action and are generally non-refundable except where required by law or expressly stated otherwise. You authorize us and Stripe to charge your selected payment method for your purchases.

6Your use of leads & outreach compliance

Leads are derived from public records and are provided to help you identify prospects. You are solely responsible for how you contact them and for complying with all applicable laws, including anti-spam laws (e.g., CAN-SPAM), telemarketing and calling rules (e.g., TCPA and Do-Not-Call), and any consent requirements. DineTracer does not guarantee that any lead may lawfully be contacted by a given method.

7Data accuracy

Public records are imperfect and change over time. The leads and enrichment (such as detected point-of-sale, phone, or hours) are provided "as is" and without warranty of accuracy, completeness, or fitness for a particular purpose. Verify critical information before relying on it.

8Intellectual property

The Service, its software, and the compiled and enriched dataset are owned by DineTracer and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service and to use the leads you retrieve for your own legitimate sales and business development. The underlying public records themselves are public.

9Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

10Limitation of liability

To the fullest extent permitted by law, DineTracer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three months before the event giving rise to the claim.

11Indemnification

You agree to indemnify and hold DineTracer harmless from claims arising out of your use of the Service or your outreach to leads, including your violation of these Terms or of applicable law.

12Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination (such as payment obligations, disclaimers, and limitation of liability) will survive.

13Governing law

These Terms are governed by the laws of the United States, without regard to conflict-of-laws rules.

14Changes

We may update these Terms; the "Last updated" date above reflects the current version. Continued use after a change means you accept the updated Terms.
