The rules for using DineTracer.
These Terms of Service ("Terms") govern your use of DineTracer (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
DineTracer compiles public government records and business information into early-stage sales leads about U.S. restaurants and food businesses, and gives you tools to search, filter, unlock and download them, and to get Monitor emails about new ones. Some leads name a person, such as an owner, principal or registered agent listed in a public filing. For restaurant database records, a lead can also include that person's phone number and email address, matched by a data provider (FastAppend). Our Privacy Policy (Section 3) explains where this comes from and what we leave out.
You must be at least 18 and give accurate information. You're responsible for activity under your account and for keeping your sign-in details secure. You can sign in with email and password or with Google.
Some features are paid for with credits bought through Stripe. Prices and credit costs are shown in the app and may change. Credits are used up when you take a paid action and are generally non-refundable, except where the law requires a refund or we say otherwise. You authorize us and Stripe to charge your chosen payment method for your purchases.
Bonus credits (on larger purchases) and referral credits (for inviting new customers, and for signing up through an invite) are free extras. They have no cash value, can’t be transferred, and are paid once per new customer, on that customer’s first purchase. Invites to your own other accounts don’t count. We may withhold or remove bonus or referral credits obtained by abuse, and we may change or end these programs; credits already added stay on your account.

Leads help you find prospects. You're responsible for how you contact them and for following every law that applies, including anti-spam law (such as CAN-SPAM), telemarketing and calling rules (such as the TCPA and federal and state Do-Not-Call rules), and any consent rules. In particular:
If someone named in a lead asks us to remove their information, we'll stop showing it in the Service. DineTracer doesn't promise that any lead may lawfully be contacted by a given method.
DineTracer isn't a consumer reporting agency, and our data isn't a consumer report. Don't use our data to decide anyone's eligibility for credit, insurance, employment or housing, or for any other purpose covered by the Fair Credit Reporting Act.
Public records are imperfect and change over time. Leads and added details (such as a detected point-of-sale system, phone number, hours or owner contact) are provided "as is", without warranty of accuracy, completeness or fitness for a particular purpose. Check important details before you rely on them.
The Service, its software and the compiled and enriched data belong to DineTracer and are protected by law. We give you a limited, non-exclusive, non-transferable right to use the Service and to use the leads you get for your own legitimate sales and business development. The underlying public records themselves are public.
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Service will be uninterrupted or error-free.
To the fullest extent the law allows, DineTracer won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue. Our total liability for any claim about the Service won't exceed what you paid us in the three months before the event that led to the claim.
You agree to indemnify and hold DineTracer harmless from claims arising from your use of the Service or your outreach to leads, including any breach of these Terms or of the law.
You can stop using the Service at any time. We may suspend or end your access if you break these Terms, or to protect the Service or other users. Sections that by their nature should survive (such as payment obligations, disclaimers and limitation of liability) will survive.
These Terms are governed by the laws of the United States, without regard to conflict-of-laws rules.
We may update these Terms. The "Last updated" date above shows the current version. If you keep using the Service after a change, you accept the updated Terms.
